The surviving spouse of Ms. Davis, her husband Johnny Davis, filed a medical malpractice suit against the surgeon and the matter went to trial. The jurors of DeKalb County, Georgia found that although the surgeon performed the surgery safely, he should have taken more precautionary measures after he finished the procedure. The jury awarded Mr. Davis $3 million in damages.
