$3 Million Awarded To Surviving Spouses Of Brenda Davis Of Monroe, Georgia.

Decisions to undergo serious surgical procedures are often made based on a trusting relationship built between patients in need of medical attention and experienced and careful physicians. As vulnerable patients, we only agree to have surgical procedures done under the assumption that our surgeon will take all the precautionary measures needed to ensure our safety and quality of life post-surgery. While surgeons are often successful when performing surgical procedures, they are capable of making mistakes. Surgeons can sometimes cause more damage or pain to a patient than before the patient underwent the surgery due to their lack of due diligence and care. This negligence can potentially result in successful medical malpractice suits.

Unfortunately, lack of due diligence during a surgery to remove an ovarian cyst allegedly led to the death of 64 year-old Brenda Davis of Monroe, Georgia. While removing the ovarian cyst, a gynecological surgeon pierced Ms. Davis’s bowel. A pierced bowel is a commonly known danger of this type of surgery; most surgeons perform inspections of the bowels for cuts after performing the surgery. The surgeon performing the procedure on Ms. Davis reportedly failed to perform that routine inspection and left her with a cut on her bowel unknown to anyone. The surviving spouse of Ms. Davis, her husband Johnny Davis, filed a medical malpractice suit against the surgeon and the matter went to trial. The jurors of DeKalb County, Georgia found that although the surgeon performed the surgery safely, he should have taken more precautionary measures after he finished the procedure. The jury awarded Mr. Davis $3 million in damages.
